Lypii Apps

Terms of Use

Terms of use for Vistadose.

Version 1.1 · the document takes effect on the day the app is releasedVistadose6 min read

These Terms describe on what rules the Vistadose app may be used. By installing and opening the app you agree to them.

In brief: Vistadose is a personal diary and organiser. It does not diagnose, does not prescribe treatment and does not calculate doses.

Who provides the app

  • Serhii Lypii, sole trader (eenmanszaak)
  • Address: Juliana van Stolbergstraat 28, 4532 AZ Terneuzen, the Netherlands
  • KvK (Chamber of Commerce): 99817039
  • BTW (VAT): NL005412268B54

Licence

You are granted a personal, non-transferable and non-exclusive licence to use the app on devices that you own or control. The app is not sold but licensed.

You may not copy, modify or decompile the app, circumvent technical restrictions or resell access to it, unless the law expressly permits it.

This is not a medical device

Vistadose is not a medical device. The app does not diagnose, does not treat, does not prevent diseases and does not predict their course. It only keeps and shows what you have recorded.

The app does not replace a consultation with a doctor, a pharmacist or another qualified specialist. Make decisions about treatment together with your doctor, and not on the basis of what the app shows.

If you think something is wrong with your health, see a doctor. In an emergency call the emergency services, do not look for an answer in the app.

No dose calculations and no dose advice

The app does not calculate doses, does not suggest the next dose and does not advise changing what has been prescribed. You enter the dose steps yourself, as prescribed by your doctor.

The medication level chart is an approximate estimate based on publicly available reference values and the data you have entered, not a measurement. It must not be used to change treatment.

The medication catalogue is compiled from open sources and may contain inaccuracies or outdated information. Check the dosage and the composition against the leaflet of your medication and with your doctor.

Medication names and trademarks

Medication names and trademarks belong to their owners and are used only so that you can record what exactly you are taking. The app is not connected with the manufacturers of the medications, and is neither approved nor sponsored by them.

Food data and barcodes

The food data comes from Open Food Facts (available under the Open Database License) and from USDA FoodData Central. It is filled in by third parties, so the composition, the weight of a portion and the nutritional values may be inaccurate, outdated or incomplete.

Check anything that matters for your health against the label of the product itself. The online barcode lookup is optional: the app asks before the first lookup, and it can be turned off in the settings.

Free and paid

The main part of the app is free: recording, history, editing and deleting data, reminders, charts, the report for the doctor and backup. Your own entries are never locked behind the paid part — they can always be viewed, edited and exported.

The premium part lifts the limits on the number of medications and custom trackers and opens additional features. What is in the free part may grow over time, but what was already free will not become paid.

Subscription, trial period and cancellation

The premium part is offered as a monthly or yearly subscription, and also as a one-time purchase for good. The exact price and term are shown on the purchase screen before payment.

If the subscription starts with a free trial period, its length is stated there as well. The subscription renews automatically until you cancel it. You can cancel it in the settings of your account in the App Store or Google Play, no later than a day before the paid term ends.

The unused part of a free trial period is forfeited if you buy the subscription before it ends.

Refunds

All payments go through the App Store or Google Play, so refunds are handled under the rules of the store. I cannot return money directly, but if the store has refused and the situation looks unfair, write to me — I will try to help.

Your data, backups and sync

The data belongs to you and is kept on your device. If you turn on the cloud copy or sync, it is also kept in your own Google Drive, in encrypted form. I have no access to it, which means I can neither restore it nor retrieve it at your request.

Backups and keeping the recovery code are your responsibility. The code is shown once; without it neither a backup file nor the files in Google Drive can be read — by anyone, me included. If the device is lost and there is no copy and no code, the data cannot be restored.

Google Drive is your own storage, and its use is governed by your agreement with Google. Its availability, the limits of the space and the preservation of the files do not depend on me.

Optional connections

Each of the following is turned on by you and can be turned off at any time. The app works fully without all of them:

  • the camera — for progress photos and barcode scanning
  • Apple Health and Health Connect — reading weight and height
  • Google Drive — the cloud copy and sync between your devices
  • the online barcode lookup and the offline food database for your country
  • crash reports and usage statistics — off by default

What you may not do

  • use the app instead of seeing a doctor
  • present information from the app as a medical conclusion
  • try to gain access to other people's data or to disrupt the app
  • use the app in a way that breaks the law of your country

Availability and changes

The app is developing: features may appear, change and disappear. I try not to break what you already use, and I write about noticeable changes in the release notes.

These Terms may change. A new version is published on this page with a new date; about material changes I will tell you in the app.

Liability

The app is provided "as is". I do not guarantee that it will work without errors and interruptions, and I am not responsible for decisions taken on the basis of what it shows.

To the extent permitted by law, my liability is limited to the amount you have paid for the app over the last twelve months. Nothing in these Terms limits the liability that cannot be limited by law, and nothing affects consumer rights.

If the app is downloaded from the App Store

These Terms are concluded between you and me, and not with Apple. Apple is not responsible for the app and its content and is not obliged to provide support. The licence is limited to Apple devices that you own or control, in accordance with the Usage Rules of the App Store.

Apple and its subsidiaries are third-party beneficiaries of these Terms and are entitled to enforce them.

If the app is downloaded from Google Play

These Terms are concluded between you and me, and not with Google. The Google Play Terms of Service apply in addition. Google is not a party to these Terms and is not responsible for the app.

Governing law

These Terms are governed by the law of the Netherlands. If you are a consumer, this does not deprive you of the protection given by the mandatory rules of the law of the country where you live.
